In medical practice, for the treatment of various ailments, toning the body, and preventing diseases, tinctures containing alcohol, which are alcoholic, alcohol-based or alcohol-ether extracts of plants, are often used. In addition to their natural origin, alcohol tinctures are also attractive because, unlike aqueous solutions, they do not deteriorate and retain their therapeutic effect for quite a long time. Tinctures are used for both internal and external use. The production of alcohol tinctures for sale in pharmacies is possible not only in pharmaceutical factories, but also in small-scale production conditions.

The list of goods that pharmacies and their structural divisions have the right to purchase and sell is approved by Order of the Ministry of Health of Ukraine dated November 26, 2004 No. 577. Alcohol tinctures for “non-medical purposes” are not on this list. Thus, only the sale of alcohol tinctures, which are medicines, is possible through the pharmacy chain. Based on Article 2 of the Law of Ukraine “On Medicines” dated 04.04.1996 No. 123/96-VR, medicines are substances or their mixtures of natural, synthetic or biotechnological origin that are used to prevent pregnancy, prevent, diagnose and treat human diseases or changes in the condition and functions of the body. In accordance with Art. 10 of Law No. 123/96 the production of medicines is carried out based on license. Individuals are also given the right to produce medicines.

The basis for issuing a license for the production of medicines is the availability of an appropriate material and technical base, qualified personnel (qualifications of a specific person in the case of individual production), as well as conditions regarding quality control of the medicines that will be produced. The list of documents that are submitted to the licensing body - the State Inspectorate for Quality Control of Medicines - to obtain a license is given in Article 10 of the Law of Ukraine “On licensing of certain types of economic activities” dated 01.06.2000. No. 1775-III.

The licensing conditions for carrying out business activities for the production of medicines are approved by the Order of the State Committee of Ukraine on Regulatory Policy and Entrepreneurship, the State Inspectorate for Quality Control of Medicines dated 03.03.2009 No. 44/27. The Licensing Conditions also apply to individuals - business entities that carry out activities in the production of medicines. Based on clause 7 of the Licensing Conditions, a license is a single permitting document that gives the right to produce medicines throughout Ukraine. Special requirements for organizing the production of medicinal products and qualification requirements for specialists producing medicinal products are specified in detail in sections II and III of the License Conditions. The production of medicines without a license threatens the entrepreneur with quite severe administrative sanctions or criminal liability. In addition, in general, an entrepreneur needs to take care of “non-medicinal” permitting documents, such as a lease agreement (ownership document) of an industrial premises, a permit from the state fire inspection, etc.

The procedure for identifying producers and buyers of alcohol and monitoring its circulation was approved by Resolution No. 1266 of the Cabinet of Ministers of Ukraine dated August 29, 2002. Please note that Resolution No. 1266 imposes special requirements for the sale of alcohol by suppliers. An agreement for the supply of alcohol must be concluded by the entrepreneur with the supplier no later than October 1 of the year preceding the delivery in four copies, two of which the supplier will transfer to the authorized government bodies. An agreement for the supply of alcohol may be concluded this year. In this case, delivery is carried out no earlier than a month after the supplier submits copies of contracts for the supply of alcohol to the authorized bodies.

To obtain alcohol, an entrepreneur must provide the supplier with a work order, a special State Tax Service certificate and a power of attorney (if the entrepreneur receives alcohol through a third party). Orders for the sale of alcohol for consumption on the domestic market are drawn up and issued by the Department of Control on the basis of orders and certificates issued by the State Tax Service and a written request from the entrepreneur. According to paragraph 3 of Resolution No. 1266, the supply of alcohol by a supplier without a work order is prohibited, except in cases of their supply to business entities whose alcohol consumption volumes are less than 60 deciliters per quarter, subject to their payment of excise duty at the full rate. Transportation of alcohol is carried out subject to mandatory prior notification of the State Tax Service and accompanied by its representative in accordance with the legal requirements for the transportation of dangerous goods. Based on clause 16 of Resolution No. 1266, buyers of alcohol with volumes of alcohol consumption of up to 100 deciliters per quarter, and buyers who receive alcohol at the full excise duty rate are not subject to special registration with the State Tax Service. Purchased alcohol must not be used for other purposes. It should be remembered that, on the basis of Article 3 of the Law of Ukraine “On excise tax rates on ethyl alcohol and alcoholic beverages” dated 05/07/1996 No. 178/96-VR, alcoholic or aqueous-alcoholic tinctures are sold at retail only through pharmacies in bottles made of medical glass with a volume of no more than 100 cubic meters. centimeters (except for medicinal products such as balms).

An entrepreneur submitting an application to include a place of storage of alcohol in the Unified Register is obliged to ensure that the condition of the storage place complies with the requirements of the Instructions for the receipt, storage, dispensing, transportation and accounting of ethyl alcohol, approved by Order of the Ministry of Agrarian Policy dated April 13, 2009 No. 264 for a specific type of raw material. Failure to comply with the alcohol storage location with the specified requirements is grounds for refusal to issue a certificate of compliance of the alcohol storage location with the established requirements and, accordingly, refusal to include the storage location in the Unified Register. Based on Article 17 of the Law of Ukraine “On state regulation of the production and turnover of ethyl, cognac and fruit alcohol, alcoholic beverages and tobacco products” dated December 19, 1995 No. 481/95-BP in case of storage of alcohol in storage places not included in the Unified register, the Department of Control may impose a fine on the entrepreneur in the amount of 100% of the value of the goods located in such a storage location, but not less than 1,700 hryvnia.

In the first of them, the actual distillation of the mash takes place, i.e. the process of heating it (when ethanol and accompanying light compounds evaporate) and cooling (and condensing) the vapor.

In the second retort (called a rectification column or distillation cube), the process of purifying the resulting ethanol from fusel oils takes place using the method of fractional distillation, when ethanol is purified from both highly volatile and heavy fractions of organic substances.

A specially equipped room is also required to accommodate distillation equipment. The distillation department (workshop) of the plant must have running water, sewerage, sloping floors and drainage drains. The height of the room and its area are selected depending on the dimensions of the distillation equipment.

The cost of equipment for the production of alcohol directly depends on its capacity. There are 2 conventional types of such equipment: small workshop and large factory.
